General Terms and Conditions for Customers

§ 1 Scope and contracting party

(1) These General Terms and Conditions apply to all contracts for the purchase of jewelry that customers conclude through the savro.co platform. The cooperation between Savro and the jewelry advisors is governed by separate agreements and is not covered by these terms.

(2) The customer’s sole contracting party is WORLD WIDE GEMS Edelsteinhandel OHG, Am Markt 3, 55743 Idar-Oberstein, Germany (“Savro”). “Savro” is a brand of the company.

(3) Savro sells exclusively to consumers within the meaning of § 13 of the German Civil Code (BGB).

(4) Savro works with independent jewelry advisors. The advisor accompanies the customer in designing and choosing the piece. The purchase contract is always concluded with Savro; Savro is responsible for manufacturing, delivery, statutory warranty and the guarantee. Binding statements regarding the contract are therefore made only by Savro, and payments are made only to Savro.

§ 2 Conclusion of the contract

(1) All pieces are made individually to the customer’s specifications (metal, stones, setting, size).

(2) Designs, quotes and prices shown in the customer portal do not constitute a binding offer.

(3) By clicking the button “zahlungspflichtig bestellen” (order with obligation to pay), the customer submits a binding offer.

(4) The contract is concluded only when Savro accepts the offer with an express order confirmation in text form. An automatic acknowledgement of receipt does not constitute acceptance. Savro accepts or declines the offer within five working days; after that, the customer is no longer bound by the offer.

(5) The contract language is German. The contract text is stored and can be accessed by the customer in the portal.

(6) Before submitting the order, the customer can review all details in a summary and correct any input errors.

§ 3 Use of the customer portal

(1) Access is granted via a one-time code sent by email. The customer protects their email account against unauthorized access and informs Savro without delay of any unauthorized access.

(2) The customer provides complete and accurate information, in particular contact and delivery details, and keeps it up to date.

(3) The customer does not upload unlawful, offensive or infringing content and does not circumvent access restrictions. Savro may remove content and block access in the event of a violation.

(4) All rights to designs, CAD files, renderings and content of the design library, in particular copyrights and rights of use, remain with Savro. The customer acquires the physical piece, but no rights to its design.

(5) If the customer uploads their own images or templates, they grant Savro the right to use them to carry out the order.

(6) Uninterrupted availability of the portal is not owed. Maintenance and outages may occur.

§ 4 Prices and payment

(1) All prices are final prices in euros and include the applicable statutory VAT.

(2) Shipping costs are included in the price.

(3) Payment is made in two stages:

(4) Production starts only after the deposit has been received.

(5) Payments are made by card or SEPA direct debit through the payment service provider Stripe, or by bank transfer to an account of Savro.

(6) If the customer is in default with the balance, Savro may charge default interest of 5 percentage points above the base rate. Further statutory rights remain unaffected.

§ 5 Delivery and transfer of risk

(1) The expected delivery time is stated in the quote. Savro informs the customer of significant delays.

(2) Delivery is insured and only against signature. Delivery to neighbors or to a drop-off location does not take place.

(3) Risk passes to the customer only on handover.

(4) Delivery is made to Germany and to the countries of the European Union.

(5) If delivery fails because the customer gave an incorrect delivery address or was repeatedly not present, the customer bears the costs of redelivery.

(6) There are no partial deliveries.

(7) If a promised stone cannot be sourced, Savro may deliver a stone of equal or better quality with only a minor deviation. Savro informs the customer in advance; the customer may reject the deviation. In that case, both parties may withdraw from the contract; payments already made are refunded.

§ 6 Right of withdrawal

As all pieces are made to the customer’s specifications, there is no right of withdrawal. Details are set out in Annex A.

§ 7 Cancellation by the customer

(1) The customer may terminate the contract at any time. In that case, Savro is entitled to the following share of the agreed total price, depending on the status of the order:

Status of the order (as shown in the portal)Share for Savro
Order confirmed, production not started (“Bestätigt” or “Confirmed”)25 %
Piece in production (“In Produktion” or “In Production”)50 %
Piece completed (“Fertiggestellt” or “Completed”)100 %

(2) The current status can be viewed by the customer in the portal at any time.

(3) The customer may prove that Savro incurred no loss or a significantly lower loss. Savro may prove a higher loss.

§ 8 Withdrawal by Savro and later changes

(1) Savro may withdraw from the contract if the deposit is not paid within 14 days of the order confirmation, if there is an obvious pricing error, if the agreed stone cannot be sourced, or if legal obstacles prevent performance. Payments already made are refunded.

(2) Change requests after conclusion of the contract require Savro’s consent. Additional costs and effort are charged.

§ 9 Retention of title

The goods remain the property of Savro until paid in full.

§ 10 Characteristics, natural products and tolerances

(1) Gemstones are natural products. Variations in color, clarity, inclusions and fluorescence within the quality stated in the quote or certificate are natural and do not constitute a defect.

(2) Images, renderings and 3D models are approximations. Colors may look different depending on the screen.

(3) For handmade pieces, deviations of up to 5 % in metal weight are permitted. The carat weight of the stones is as stated in the quote or certificate.

(4) The customer confirms the ring size. An incorrectly stated size is not a defect.

(5) The customer is responsible for the spelling and content of an engraving; the text is confirmed in the portal before production starts. Engraved pieces cannot be reworked.

(6) The customer warrants that they hold the rights to texts and images they provide. Savro may decline unlawful or offensive content.

(7) Certificates (GIA, HRD or IGI) are stated in the respective quote. Every piece comes with a certificate of authenticity from Savro.

§ 11 Statutory warranty

The statutory liability for defects of two years from handover applies. These rights are not limited by the guarantee under § 12.

§ 12 Guarantee

In addition, Savro grants a voluntary guarantee of four years. Details are set out in Annex B. The customer’s statutory rights remain unaffected.

§ 13 Liability

(1) Savro is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

(2) In cases of simple negligence, Savro is liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded.

§ 14 Care and insurance

(1) Every piece comes with care instructions. Damage caused by not following them is excluded from the guarantee.

(2) Savro’s insurance cover ends on handover. Insuring the piece after that is the customer’s responsibility.

§ 15 Data protection

The privacy policy at savro.co/legal applies.

§ 16 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.

(2) Should any provision be invalid, the rest of the contract remains valid.

(3) Savro is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

(4) Changes to these terms apply only to future orders. The version valid at the time the contract is concluded applies.

Annex A: Right of withdrawal

Exclusion of the right of withdrawal

Under § 312g (2) no. 1 BGB, there is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs.

All pieces from Savro are made to the customer’s individual specifications, in particular regarding metal, choice of stones, setting, size and, where applicable, engraving. There is therefore no right of withdrawal.

The customer confirms this notice before placing the order.

The right to cancel under § 7 of these terms remains unaffected.
